You may have a legal problem and not know how to resolve it. Lawyers have been specially trained in the law and the right lawyer can advise and assist you with your particular problem.

Bring the names, addresses and telephone numbers of everyone connected with the case. In addition, bring all papers related to the case. Some lawyers may want to review the papers before your meeting.


Ask about any similar cases that the lawyer has handled. And keep in mind that age may have nothing to do with the lawyer's ability to help you.

A lawyer who has practiced 20 years may have less experience with your type of problem than a lawyer who is three years out of law school. Dont prejudge!

In addition, find out if the lawyer will handle your case personally. If the lawyer intends to have another member of the law firm handle any part of the case you might want to talk to the second lawyer as well.

Be wary of any lawyer who guarantees results. Most lawsuits and other legal work are not "sure things." However, a lawyer should be able to point out the strengths and weaknesses of your case.

Find out how long the lawyer expects your case to take, what steps will be involved and what and how you will be charged. If you don't understand something ask for an explanation. Also ask yourself:


Do you think the lawyer has the experience, ability and skill to handle your case?
Do you understand the lawyer's explanation about your case and the fees involved?
If your answer to one or more of the questions or recommendations is "no" you should talk to another lawyer. If all of your answers are "yes" you may have found the right lawyer.

Ask the lawyer to explain the various steps involved in handling your problem.You also could request copies of all letters and documents prepared for your case. You may also want to know how often the lawyer will update you.

Depending on your case the lawyer may be able to provide a timetable that sets out the steps in the case. However this may not always be possible. If you are involved in a lawsuit, for example, the court's schedule and backlog will influence how long your case will take.

If you have any questions as your case moves along, call and ask the lawyer. However, keep in mind that depending on the fee arrangement you could be charged for the lawyer's time during the phone call.


Is it important to have a retainer agreement?

Yes. You and your lawyer should agree on what you will pay the lawyer and what services will be provided.

This way, both of you will know what to expect from each other.
But even if the lawyer fails to draw up a written retainer agreement, you may still have to pay the lawyer a reasonable fee for any work done. In any case it is always a good idea to have a copy of the agreement for your records. What should be in the agreement?

The agreement should list the services that the lawyer will perform for you and the type and amount of fees that you will be expected to pay.
The agreement should also explain how the costs (the other expenses and disbursements made or incurred by your lawyer) will be handled and billed.
An agreement may also include your obligations as a client - to be fully truthful, cooperate and pay your bills as set out in the retainer agreement with your lawyer.

In creating an agreement with your lawyer, make sure that you understand all of his or her terms. If you are not sure what to ask you might want to bring a friend or relative along with you when you meet with the lawyer.


Here are a few key questions:
· How will the lawyer bill for his or her time? What can be done to reduce fees and costs?
· What is the lawyer's estimate of the total charges?

How will costs as opposed to fees be paid?
Keep in mind that an estimate is just that - a calculated guess as to how much the fees and costs will be. The amount can change as circumstances change.

The lawyer usually has a pre-prepared retainer agreement. If you don't like any part of it ask the lawyer to make revisions or to draw up a new agreement.

Make sure you understand the agreement before you sign it. If you are not comfortable with any of the terms don't sign it. And if you can't work out your disagreement, you may want to find a different lawyer.


How does a lawyer decide what to charge?

Lawyers consider various factors when setting their fees. A lawyer who is well-known in a certain area of the law might charge more than someone who is not.

If so you will need to consider whether the lawyer's special skills and experience will actually lead to a better or faster resolution of your problem.

A lawyer also might consider the complexity of the case and the amount of time your matter could take.

For example, the hearing or trial in your lawsuit may take just a few hours. But the lawyer may have spent days, weeks or even longer preparing for it - researching the law, finding and interviewing witnesses and preparing documents and arguments for that hearing or trial.


Do all lawyers charge the same kind of fee?
No. There are several types of fee arrangements and they are invariably in writing.

If the fee arrangement is for a contingency fee - which means the lawyer will get a percentage of the settlement or award if you win the case - the agreement should be in writing and include the agreed upon percentage.

With non-contingency arrangements the fee agreement should include the lawyer's hourly rate and other standard rates, fees and charges that would apply to your case. It should also explain the general nature of the services that the lawyer will render for you.

Most of the time it may be impossible for a lawyer to know exactly how much time the lawyer will spend on your case. You can however ask the lawyer for an estimate of the time and costs.

But do not forget that many unexpected factors could drive up the cost. For example, your case might involve a counter claim. This means that the person you are suing is also suing you. A counter claim could affect the type and amount of the lawyer's fee.

Apart from any fee you may pay for your first meeting with a lawyer you probably will be charged either a fixed, hourly, retainer or contingency fee.

Fixed fee. This type of fee is commonly used in simple or very routine legal matters. For example, a lawyer may charge all clients the same amount to draw up a simple will or handle an uncontested divorce.

Before agreeing to a fixed fee find out what it does and does not include. You also should find out if any other charges might be added to the bill.

Hourly fee. Most lawyers charge by the hour and the amount can vary from lawyer to lawyer. Ask the lawyer to estimate the amount of time your case may take. You will need to decide whether this lawyer has the skills or experience that could bring your case to a faster resolution.


Also remember that circumstances may change and your case may take longer to handle than the lawyer initially expected.

Retainer fee. This kind of fee can mean different things to different people; make sure you understand the fee as set out in the retainer agreement.
It is in effect a deposit you make on account of the lawyer’s fees and it must always be maintained at the same amount since the lawyer draws against his/her fees for services rendered.

A retainer fee can be used to ensure that the lawyer will be available to take a particular case. This could mean that the lawyer would have to turn down other cases in order to remain available.

With this kind of retainer agreement the client would be billed additionally for the legal work that is done. If the fee agreement is a non-refundable retainer agreement, you may not be able to get your money back - even if the lawyer does not handle your case or complete the work.

A retainer fee also can mean that the lawyer is available to handle the client's legal problems over a period of time. Certain kinds of legal work might be covered by the retainer fee while other legal services would be billed separately to the client.

In addition, a retainer fee sometimes is considered a "down payment" on any legal services that the client will need.

This means that the legal fees will be subtracted from the retainer until the retainer is used up. The lawyer would then bill you for any additional time spent on your case or ask you to replace the retainer.

Contingency fee. This kind of fee is often used in accident, personal injury or other types of cases in which someone is being sued for money.
It means that you will pay the lawyer a certain percentage of the money you receive if you win the case or settle the matter out of court.
If you lose the lawyer does not receive a fee.

Either way you will have to pay the court costs and certain other expenses. Depending on the circumstances these charges could be quite high. Ask the lawyer for an estimate of such costs.

In some cases, the lawyer may pay some of these costs for you when they are due using money that you receive from the case if you are successful.
If you agree to a contingency fee make sure that the retainer agreement spells out the lawyer's percentage and whether his or her share will be figured before or after other costs are deducted. This can make a big difference.

Suppose, for example, you were awarded $200,000 in a personal injury case and your lawyer was entitled to 30 percent. Court costs and other expenses amount to $20,000. If your lawyer's share is figured after the $20,000 is deducted, the lawyer will receive 30 percent of $180,000 - or $54,000; you will receive the balance of $126,000.

But, if the lawyer's share is figured before costs are deducted, the lawyer will receive 30 percent of $200,000 - or $60,000; then, after the $20,000 in costs is deducted from the remaining amount, you will receive $120,000
Contingency fee agreements should also state, among other things, whether you will be required to pay the lawyer for related matters (matters not specifically covered in the written fee agreement) that might come up as a result of your case.

In many cases, know the agreement will also what the lawyer's fee is and that it is set by the lawyer and the client - not by law.
What additional out-of-pocket costs will I have to pay?

The lawyer will charge you for the costs of your case as well as the fees. You will be responsible for paying these costs even if your case is not successful.

Costs can add up quickly. It is a good idea to ask the lawyer for an estimate of what the costs will be. You can tell your lawyer that costs over a certain amount have to be approved by you in advance.
Here are some typical costs:
· Shorthand reporters' charges for taking down testimony at examinations for discovery, depositions, trials and for providing written transcripts of the testimony.

· Copying and fax costs. These are usually charged on a per page basis. Lawyers also may charge for secretarial time spent on these tasks and telephone charges.
· Experts and consultants' charges. These costs generally relate to any time spent evaluating the case and testifying in court.
· Filing fees, which are required by courts before they will accept legal papers for filing.
· Investigators' bills. Investigators may help gather facts related to the case. They usually charge by the hour and may bill for expenses such as mileage, meals and lodging as well.
· Postage, courier and messenger costs for mailing, shipping or personally delivering documents to you or others involved in your case.
· Service of process fees (process servers) charged by individuals who locate parties and witnesses and deliver legal papers to them.
· Staff time for secretarial services including overtime, word-processing time, etc.
· Telephone calls and telephone bills for long distance calls.
· Travel expenses for the lawyer when he or she travels on the client's behalf. These charges can include gasoline, mileage, parking fees, meals, airfare and lodging.
· Witness fees and mileage charges.


The individuals who testify at trials, hearings, exams for discovery or depositions also receive fees. You also may need to pay travel expenses if a witness must be brought in from far away.


Your lawyer may charge you for other costs as well. Make sure you understand all of the costs for which you will be responsible.

Ask the lawyer if you will have to pay such costs directly or if you will be reimbursing the lawyer for such costs paid on your behalf.
When is my lawyer's bill due?

If you are paying by the hour, you may want the lawyer to get your permission before spending more than a certain amount of time on your case. You also can ask for itemized bills detailing how the lawyer spent time on your case.

Choosing a lawyer because he or she appears to be understanding and friendly may lead to later dissatisfaction.

While the Yellow Pages or a television advertisement may be a good place to start, keep in mind that such sources are merely that and only a starting place.

Lawyers should be selected for their expertise and experience in specific categories of cases.

The "right lawyer" is the person who has substantial experience handling a case very similar to yours, who can and will take action at once-from the lawyer offices to the court rooms.

She or he does not have to "look into it," "think about it and call you back" or "check the most recent court decisions."

The "right lawyer" knows what to do immediately, acts effectively and with little wasted effort or wasted expenditures of your money.

Your search for the "right lawyer" should be expected to take several days to even weeks depending where you live-in a large city as Toronto or in smaller cities or towns. It is often said that finding the right lawyer is almost like a trial itself.

Although it is a challenging process this commitment will yield important rewards. Start as quickly as soon as possible because there may be statutes of limitations or other deadlines that may be critical. In some cases you have only a limited window of opportunity to take legal action.


Think carefully about the legal services you require. You may need on-going, regular legal advice from someone who has experience advising individuals or businesses in your occupation or profession.

Other lawyers have particular experience in drafting contracts or wills, representing estates or working through land development or zoning-related issues.

Many lawyers practice law for a lifetime and never set foot in a courtroom because their work is primarily consultative and oriented toward planning.

You would do a literature search, call coaches, talk with players, call Las Vegas to learn what the professionals had to say, and find videotape on film of previous matches. The same approach applies when it comes to finding the "right lawyer."

Lawyers find the "right lawyer" by networking with the members of their profession who have experience in related areas. After making multiple calls they develop a "short list" of lawyers with special expertise. There are many ways that you can achieve the same goal.

If you are reading this article on the Internet, you have access to search engines, such as Google, the best in my opinion.

Google. Yahoo, Bing and other search engines, also allow you to enter "class action," "defective products," toxic chemical" or the like to locate lawyers with special experience. Check the law lists on the world wide web. These lists are growing daily.

You need URL capability through Internet Explorer or Firefox, for example, both of which are freely available. The best is Google. Also see West's Law Directory or Canadian- Lawyer, both have websites and there are others listing lawyers that you can search.

In addition the internet provides a database of numerous lawyers and if your local newspaper is online, a search of that database can provide information about lawyers with special backgrounds and experience. In using any of these sources look for qualifications and experience that are factual.

Every city or town has lawyers who are experts in specific areas of the law. Finding a specialist requires more than asking friends and relatives for their recommendations.

Unless they have extensive experience with the legal community and its assistance, the advice obtained has to be considered in the context of their backgrounds in retaining lawyers.

To rely merely upon advice from friends and relatives may greatly limit your prospects unless they are involved in a line of work that is related to your problem.

For example, designers, craftsmen, decorators and others in related fields know who does the best job of picture framing in town.

For example, if one of your family members has been served with divorce papers and while you try to help them find a lawyer-while looking for a lawyer, you learn of two family law specialists and a "brilliant trial lawyer."

The key is networking. Call the "brilliant trial lawyer" and ask him or her if they do divorce and related work and if not, ask them who they would hire if they were sued for divorce or who they would recommend.

If you have a family or business lawyer you rely on and trust, your work is all the easier, but watch out. If your lawyer refers you to someone in his/her firm, this person may not be your best choice.

Consider that person as someone to be added to your short list but nonetheless follow the guidelines and suggestions you will find here before you make a final decision.

Perhaps one of the best places to start is a law library where you live. At it you will find a number of directories and source books which will help you develop your "short list."

But since many start with the Yellow Pages-and many also start with the internet, understand what you can learn there. The Yellow Pages are paid advertising.

The bigger the ad, the larger the volume of cases handled by that lawyer. This may be what you need for a commonplace garden variety cases but no major corporation picks its lawyers out of the Yellow Pages. Ignore the hyperbole and look for facts in the Yellow Pages or the internet that confirm the experience you can need.

Your law library and most main libraries contain a USA/Canadian listing of lawyers published by Martindale-Hubbell and
www.canadian-lawyers.ca/ two of the best all-around sources of information about lawyers.

The Martindale-Hubbell Law Directory lists lawyers in practice primarily in the USA-state by state and city and Canadian Lawyers-province by province and city.

You'll be able to learn about lawyers particular backgrounds, areas of practice, bar activities, honors, articles, and other aspects of their practices.

But, more important, both directories rates lawyers for their legal skills, ethics, and professionalism. While the rating system is not perfect the directories conduct confidential surveys of local judges and lawyers. Few very good lawyers are unrated.

To check an attorney's most recent record of courtroom successes, jury verdict reporting services are available. Every law library contains these commercial services subscribed to by lawyers, insurance companies, and others interested in what is taking place in courtrooms on a daily basis.

A jury verdict reporter details the results of cases and provides information concerning lawyers, the particular facts of cases, testifying experts, and the result, usually on a regional, statewide and national basis.

Some of the services provide annual compilations listing lawyers and experts who have appeared in jury trials over a given year. Because the reporting of trial results is unofficial and voluntary these reports are not perfect or complete.

For many people "cold calling" is not easy, but you may gain valuable information if you contact some of the local legal community's leaders. The Law Societies in each Canadian province has the names of all practicing lawyers in each Province.

Do use a referral service to meet with a lawyer to determine whether or not you should be making a claim and learning what steps are immediately necessary to protect your rights. It is also an excellent opportunity to gain experience talking with a lawyer and practicing your negotiating skills.

Interviewing the specialist. There is no substitute for a face to face meeting when you are trying to select a lawyer. You will not only learn whether a lawyer has the necessary expertise, but also whether you could form a comfortable working relationship with him or her.

Call each lawyer on your "short list" to see who would be available to be interviewed about taking on your case, and what the fees would be for the meeting.

Some law firms provide clients with a brochure, press clippings or a curriculum vitae, which details a lawyer's education, achievements, and experience.

Ask for any information available on the lawyer or your subject matter, and review it carefully. This is the time for comparison shopping. Read for substance and compare the background and work experience of one lawyer with another before you call for an appointment.

When you call for an appointment describe your problem in twenty words- as clearly and as simply that you can. When you meet you should give a clear summary of your situation and the services you are seeking.


It is helpful to bring a one page summary of all the relevant information, including dates, times, names and addresses and which provides basic "who, what, where, when, why and how" information.

For an example of basic information a lawyer will need open a file for you. Come prepared with documents that help tell your story such as correspondence, photographs, accident reports, police reports and medical records.

By examining this information the lawyer can quickly determine if she or she has a conflict of interest, in which she or he represents someone whose legal interests are in opposition to your own.

When talking with a lawyer pretend you are talking with your car repair mechanic and ask the same questions:
1. How bad is it?
2. How soon do I have to do something?
3. Have you done this before?
4. Are there any options?
5. What are the odds of getting it fixed?
6. At what price?
7. When will it be done?
8. Who is going to do the work?
9. When can you get started?

If you or a family member have been injured, you may discover that your case requires prompt action. There are critical deadlines, called "statutes of limitations” that restrict the time you have to file a claim against the party responsible for your injury.

In many provinces the rules adopted by the legislature requires all claims for personal, property or business injury be filed within two years. In most provinces if you file one day late you lose.

So, always move quickly to preserve your rights. Acting quickly also serves preserve important evidence that may otherwise disappear. Every major insurance company and corporate defendant begins investigating potential claims immediately. So should you. Evidence should be preserved where it cannot be lost or harmed in any way.

An experienced lawyer's record should speak for itself. Check the results this lawyer has obtained for clients who needed the same kind of services. Learn if he or she generally works with a certain category of individuals or businesses, since specialization is to your advantage.


Ask a trial lawyer how many cases like yours she or he has both tried, won, lost or settled. Do not be afraid to ask for a copy of a trial brief, settlement conference, or pre-trial statement that was filed with the court so better acquaint yourself with the type and quality of the lawyer’s work.


Many lawyers will work with other lawyers, their partners and employees who are called "associates" on your case.

It is important to know what their qualifications are, check what their level of involvement would be, and whether the person you are interviewing would be the lead attorney or decision-maker on your case.

Find out who will be working on your case on a day-to-day basis. Ask to meet the legal staff, if they have not been introduced to you.

Remember that when you are in a hospital you see the doctor usually once a day, but it is the nursing staff that provides hourly care. The same is true in the law office. Lawyers perform direct services, but they also give instructions and orders to others. Find out who those people are and what they do.

You should ask what course of action the lawyer suggests in your case,and be wary of an answer that contains lots of assurances but lacks concrete steps and a range of time the tasks would require.

Determine what procedures will be followed to make sure all time deadlines will be met in your case.

Many cases require the testimony of an expert, who is a specialist in a given field, many times a university professor, medical doctor, economist, accountant, or scientist.

You should ask whether your case would be assisted by an expert, what kind of expert should be considered, which experts your attorney recommends, and when they should be retained. How much will they charge and who pays is discussed below.

Keep in mind that if you are going to litigate your lawyer will need to tell your story to a judge and a jury. You should try to imagine what kind of impression the lawyer would make on them, and how convincingly he or she would present the facts of your case.

As a routine practice, determine how you and the lawyer would resolve how your case should proceed. Does he want to make all the decisions or does she or he enjoy shared decision-making? If there is a disagreement, are they open to second opinions and what happens if you do not get along.

How would a change of counsel be accomplished? You should determine whether the lawyer carries adequate professional liability insurance for a case like yours.

In addition, ask if he or she has ever been sued for malpractice, how many times and more importantly the outcome. No professional should be offended if you explain that you are bringing up these unlikely possibilities as a matter of policy.

No interview would be complete without finding out what your own responsibilities would be. Ask if there are any tasks you would be involved in and what your role in decision making would be.

Most clients make the mistake of expecting the lawyer to initiate communication with them and most lawyers intend to do so and desire having a well informed client. But without a formal structure, it will not happen.

Understand that initiating communication is your responsibility and do not expect to be able to accomplish it by telephone. Many lawyers are frequently out of the office, appearing in court or taking depositions.

Busy lawyers do not remain in their offices all day. Court appearances, arguing motions, interviewing witnesses, taking depositions into the dinner hour, traveling to meetings outside the office, attending continuing education programs and bar meetings are common.

They will routinely not be there to accept a random call and may not be able to call you back when you will be available. Telephone tag does not accomplish your goal of being informed.

Be sure that you talk about the best ways to keep each other updated. Telephones do not work nearly as well as regular face-to-face meetings or scheduled telephone conferences.

Plan on follow-up meetings with your lawyer at agreed upon times, perhaps every 30 days at first and thereafter as needed.

Ask for copies of correspondence and documents filed in court. If you do not understand what they mean, save those questions for your next meeting. You must stay informed, but you do not want to abuse your welcome, even though you may be very anxious about your case.

Consider your lawyer in the same manner as you do your doctor. After you see a physician it is common for him or her to order tests, prescribe medication or to take some other action, but always you are asked to come back in a certain period of time.

The doctor does not make the appointment. You do. Follow the same practice with your lawyer and arrange for follow-up meetings.

One of the best ways to do this is by scheduling telephone conferences. Ask the lawyer, legal secretary or other person responsible for scheduling to set a meeting by phone when the lawyer expects to be in the office.
This will help you avoid telephone tag and increases the probability of a successful exchange of information.

Read and understand the retainer-fee agreement
If you think you have found the "right lawyer," you will want a written retainer agreement that contains the lawyer’s fees and charges.

Unless you sign a written agreement at the outset the probability of your having an amicable conclusion to your relationship is zero.

Ask for a copy of the agreement. As with all documents, make sure that you understand it fully before you sign it. No reputable lawyer will pressure you to accept an agreement on the spot.

After your interview, take time to consider whether you would be comfortable in working with this person as your lawyer.

Ask yourself whether or not she or he gave you clear and direct information. Will they be available in an emergency? Consider if the attorney spoke knowledgeably and with a minimum of legal terms.

Think about whether this lawyer understood and shared your goals. As a client will you be a co-participant or will the lawyer be making all the decisions? Did the lawyer give you his/her home phone number if you have an emergency?

A rare feat but not for Irving Solnik!“My client, George, is a young man who is studying for his Masters Degree at York University and works part time-a substantial amount of hours each week working with, repairing, building and selling computers.”

He is quite knowledgeable and talented in Information Technology and computers and is studying for his masters degree.He had a girl friend, Nicole-they had been dating for almost ten years-since they were young teenagers.

One night he drove over to Nicole’s parent’s home-she was living with her parents-who treated my client virtually as a son. After all and he had been with their daughter for about ten years.About one hour after George arrived he and Nicole began to argue and the argument became heated with each of them shouting at the other. The argument began when it became apparent to George that Nichole wanted to date or in fact dated others and George became jealous because he loved Nichole.


The vehemence of their arguments increased greatly until they had the mother of all arguments during which the verbal onslaughts increased in intensity.

Then after a particularly heated exchange of words Nichole committed a heinous act. She dialed 911 on her cell phone and called the police. She told them George had criminally assaulted her that evening and that George had stolen her cell phone. (He had taken it to see the telephone numbers she had dialed to determine if she was calling another man. He then left the cell phone in her home and had not stolen it as Nichole stated).

The alleged criminal assaults he had made were such that Nichole stated to the police that he had criminally assaulted her whereas in fact each of them hurled barbed angry words in anger against each other on the telephone.However when she spoke to the police she omitted to state that the alleged assaults-words only-that were made on the telephone.

George then decided to leave the house and return to his home when Nicole’s mother called him and told him the police were at her home and that George should return. George did so and as soon as he arrived at the house he was immediately arrested by the police, handcuffed and taken into the basement of the home for questioning.

He was kept there for several hours before he was taken to the jail and incarcerated.Prior to George’s removal by the police Nichole’s mother made several futile attempts to talk to them and tell them that George and Nichole had an argument-no phone was stolen and there were no criminal assaults made by George.

The police told her she should keep quiet and that she was a “bad” mother because George, according to the police, was “no good” and how could Nichole’s mother stand up for him because he “stole the cell phone and criminally assaulted her daughter.”

They told her to sit down and not to interfere. She then sat down beside her husband and both could not believe what was happening.George had no criminal record-not even a driving ticket and the same not withstanding everything, George was put in the holding cell at the police station for several hours before he was released by the police after he signed a peace bond and agreed to refrain from contacting Nichole or her parents.

He was also to appear in criminal court several days later.The police grossly over reacted to the telephone call by Nichole. Six heavily armed police 0fficers-SWAT TEAM members were sent to arrest George and they treated him as if he was a well known and dangerous criminal or terrorist, in their zealousness.

In fact George was born in Iran as a Moslem but had lived most, if not all of his life in Canada. Nichole’s parents were well aware of this and nevertheless treated George as well as they would have treated their own son-if they had a son-not a daughter.

The action of the police was akin to swatting a mosquito with a cannon. Heavily armed SWAT TEAM officers came for him as if he were also heavily armed and a threat to them as well as Nichole.George appeared in criminal court at the specified date and time where he was given a written disclosure of the evidence the police had put together and another date and time was set when George was to appear again in criminal court to set a date for a trial.

By this time George realized that he was in serious trouble and faced criminal charges that might include a jail term and/or a fine. If such did happen he would have a criminal record for life that could readily jeopardize his future.He then called me and explained all that transpired.
I was stunned to hear that he was arrested by 6 SWAT TEAM police officers and treated in the degrading manner that he was treated-as if he was a highly dangerous and infamous criminal.-terrorist.

Was it because he was a Moslem (not practicing) and Iranian by birth? Or were there other undisclosed obscure reasons?This was the very first time that I, as a lawyer, can remember or have ever heard of a six member SWAT TEAM being sent on a minor domestic issue.

What other surprises were in store? It became obvious that I must change my strategies and tactics that usually always succeeded in the past for similar domestic issues.I pondered what must be done and finally decided on the unique strategy and blitzkrieg tactic I should use.I would put the new strategies and tactics into effect at the next court hearing that was two days away.

Then I briefed George on what he must do-nothing-until I advised him otherwise.I entered the court room, signed in as counsel and asked one of the Crown attorney’s assistant if she would put my case at the head of numerous cases to be heard.

She did not say a word but flashed me a rather dirty look that did not augur well.The first case was heard and to my great surprise, my clients name then reverberated over the din in the Court room. I told the Crown attorney that I wanted a crown pretrial immediately.

Without another word I addressed the Crown but looked at the Judge and said “I want a pretrial with the Crown now.” The crown attorney looked at me in surprise but also noted that the Judge had indicated agreement.

She then asked when I wanted the pretrial and I answered-“now, or the very next one available.” I then asked the Crown Attorney (the prosecutor) if she had more disclosures for me and she indicated negatively.She agreed to my request and I left the courtroom with George in tow where two crown attorneys were deep in negotiations with two other lawyers.


Without being asked I seated myself on the only vacant chair in the closet like office and awaited my turn-it came quickly, to my delight. I then presented my argument to the Crown, pointed out the holes in his case, stressed the use of the SWAT TEAM and their actions.

How would it look if it was made public that a six member SWAT TEAM was involved in a minor domestic argument between two young people barely out of their teens. The Crown attorney obviously knew what I was hinting at.

He, the crown attorney, was obviously embarrassed and I suggested that George pay $50.00 to a charity of the Crown’s choice but the Crown said no.He wanted George to pay $1000.00 to a charity in return for withdrawing the two charges against George.

After several minutes of negotiations we agreed on $400.00 that was to be paid to a charity of the Crown’s choice. I thanked the Crown for his compassion and understanding and then went to where George was sitting and fidgeting nervously.

During the course of negotiations I gave the Crown several witness statements-from Nicole and from her parents. The statement from Nichole was difficult to obtain but at the very last minute she signed it.The statements totally refuted the criminal charges and explained the ludicrous actions of the six police officers-the SWAT TEAM.

If the charges had not been withdrawn and a trial was held, the police would appear like idiots-six heavily armed police against a young man-a University student, with no criminal, not even a driving ticket on his record?The reputation of the police would be ruined-especially the SWAT SQUAD. The Crown obviously was aware of this for I pointed it out in no uncertain terms and graciously withdrew the charges.

Obviously my strategies and tactics worked well! Firstly I demanded a pretrial with the Crown that was totally unexpected-my intended strategy that had spectacular results.

Secondly my tactic of having the witness statements prepared and signed, was my first tactic-again a tactic that yielded spectacular results.

My third tactic was to show the Crown and allow him to read the witness statements and my allowing the Crown attorney to read them was the coup d’etat.It is virtually a rule that nothing the defense lawyer has is ever divulged to the crown and is to be used only at the trial and never before. I rarely break true and tried rules and I did bend and break them in this matter for a number of vital reasons. The most important reason was that the Crown needed the evidence from Nicole when she would be examined by the Crown and the evidence she would give would surely make a laughing stock of the Crown and the Attorney General.


They would find it most difficult to cover it up in the future.

The last tactic I made was to suggest to the Crown how foolish it would appear to the public and others, what the SWAT TEAM had done.

All is well that goes well and in George’s case not only did my actions-strategies and tactics-go well-they were spectacular successes.George is a free man now without a criminal record and he is free to pursue his studies for his master’s degree. Nicole initial statements to the police made in the heat of anger simply backed fired and caused her much embarrassment.

The Hospital for Sick Children is $400.00 richer thanks to George’s charitable donation and thanks to the Crown attorney for his compassion and understanding.

All is well that ends well or so I thought.When I address this case again in the very near future the ultimate truth of what Nichole’s words and actions would be revealed.

Finally had my strategies and tactics not succeeded when I used them, George could possibly have been convicted and would always have a criminal record for the rest of his life that could have had an adverse effect on his future.

Should I Just Plead Guilty? No. Never-Ever--Don’t consider pleading guilty unless you are guilty according to the law.You may think you are guilty but you may not be legally guilty unless there was “mens rea"-guilty intent.
The prosecutor or crown attorney must prove beyond a reasonable doubt that you committed the offence you are charged with.There are numerous defences that an experienced lawyer can use to show there is reasonable doubt to an impartial Judge or Judge and jury.

Never plead guilty!Unless you have spoken to an experienced criminal lawyer and revealed to him/her everything truthfully-a moral and categorical imperative-never plead guilty.
